The Legal Notice published on this website identifies the owner as established in Article 10 of the Law on Services of the Information Society and Electronic Commerce and contains information on the personal data protection policy.

The products offered on this page are intended for consumption, so the purchase contract is made at the time the customer issues the express confirmation of their order. For this reason, JOAN AYGUADÉ JARQUE, recommends reading the full legal notice and these general conditions before accepting the order.

This contract is entered into within the legal framework established for Electronic Commerce by Law 34/2002 on Services of the Information Society and Electronic Commerce, taking into account Law 7/1996, of January 15, on the organization of commerce retailer, Law 7/1998, of April 13, on general contracting conditions, Royal Legislative Decree 1/2007, of November 16, which approves the revised text of the General Law for the defense of consumers and users and Law 3/2014, of March 27. The contracting conditions are as follows:

Characteristics of the products. The characteristics of the products offered on this site appear on the screen together with their visual identification.

Prices. The current prices that appear on the website at the time of formalization of the order will be applied. The price of each of them is detailed along with its description. VAT is included, this will be disaggregated later in the purchase process.

Languages in which the order can be made. Spanish and English.

The steps to follow to order. You must select the items that interest you by informing the number of units and size number and “add to cart” button to add them to the shopping cart. You can view the content of the shopping cart at any time, showing the selected items, their price and taxes. From this same window, before sending the order, you can correct, change or cancel the selected products.

When you have finished choosing products, click on the “cart” option and “checkout”. If you have a discount coupon, you can include the code at this time to enjoy the discount. If you are registered as a user you will have to inform your credentials, otherwise, you must provide your personal information for billing. Once the user data has been validated, the delivery address will be confirmed and the shipping method will be chosen.

Subsequently, it will be necessary to accept the Conditions of Purchase by marking an acceptance box. As a last step, you must choose the payment method and you will be redirected to the payment gateway. Once the process is complete, you will receive a confirmation of your purchase.

Order tracking. Once the order has been placed, it will be filed so that it can be accessible through Internet until its delivery has been completed.

Confirmation of Receipt of Order. Each time the company receives an order, a confirmation email is sent within 24 hours of receipt, except in case that it is received on holidays or weekends, in which case the confirmation will be sent on the working day following the reception day.

Payment Methods. JOAN AYGUADÉ JARQUE. provides different payment methods. Each of them with very high security standards to ensure a trustworthy payment. The payment of the product price will be made by any of the forms indicated below:

• Payment by credit card. Visa, MasterCard, Maestro or American Express. The customer can chose the payment by credit card so that the operation will be confirmed at the time the purchase is placed.
• Payment by PayPal. The user is aware that payment by this means implies acceptance of the PayPal privacy conditions, unrelated to those of this website.
• Payment by ShopPay. The user is aware that payment by this means implies acceptance of the Shopify privacy conditions, unrelated to those of this website.
• Payment by GPay. The user is aware that payment by this means implies acceptance of the Google Payments privacy conditions, unrelated to those of this website.

Right of withdrawal. In accordance with the provisions of the General Law for the Defense of Consumers and Users, the client will have the right to withdraw from the contract for a period of 14 calendar days without the need to indicate justification, except for legal exceptions.

The withdrawal period will end 14 calendar days from the day purchase is delivered. To exercise the right of withdrawal, the client must notify his decision to withdraw from the contract through an unequivocal statement (for example, a letter sent by post, fax or email). You will be able to use the model withdrawal form that appears below, although its use is not obligatory. Both the email and the postal address to which you can direct your request appear at the end of these conditions of purchase.

To determine the observance of the deadline to withdraw it will be taken into account the date of expedition of the withdraw declaration. JOAN AYGUADÉ JARQUE. will communicate without delay to the client in a durable medium the acknowledgment of receipt of the said withdrawal, in case of receiving the exercise of this right by email.

JOAN AYGUADÉ JARQUE. will refund any payment received from the customer, including, where applicable, delivery costs, without delay and, in any case, before 14 calendar days have elapsed from the date on which it was informed of the decision to withdraw from the client’s contract. JOAN AYGUADÉ JARQUE. will make the refund using the same means of payment used by the client for the initial transaction, unless the client expresses otherwise and as long as he does not incur any expenses as a result of the reimbursement. However, if the customer has expressly selected a delivery method other than the less expensive mode of ordinary delivery, JOAN AYGUADÉ JARQUE. will not be obliged to reimburse the additional costs derived from it.

The customer must return the products to JOAN AYGUADÉ JARQUE. in perfect condition, without any undue delay and, in any case, no later than 14 calendar days from the date in which it has informed about its decision to withdrawal from the contract to JOAN AYGUADÉ JARQUE. It will be considered that this term has been fulfilled if the customer returns the product before the period of 14 calendar days has expired. The customer will only bear the direct costs of returning the order.

The client will be responsible for the decrease in the value of the products as a consequence of its manipulation in a way different to the necessary to stablish its nature, characteristics or functioning.

Withdrawal form. JOAN AYGUADÉ JARQUE. provides this form to customers who, having bought a product on this website, want to withdraw from the purchase agreement. However, and in order to facilitate the right to withdrawal, all the fields of this form must be completed by the client:

Applicable warranties. All products offered through the website are completely original, unless it is indicated in their description. All of them have a warranty period of three years, according to the criteria and conditions described in the Royal Legislative Decree 1/2007, by which it is approved the revised text of the General Law for the Defence of consumers and users and other complementary laws.

Shipping modalities, delivery time and transport

Shipping costs: Shipping costs are not included in the price of the products offered on the Web. Shipping costs will appear for express acceptance by the user before ending the purchase process and once the user has provided the shipping address for the order. You will be able to see the expenses recorded in the invoice. In case of return of the merchandise, the shipping costs will be borne by customer account.
JOAN AYGUADÉ JARQUE will charge shipping costs for each delivery.

The shipment of the order will be pending until all the products are available. If the client wants receive partial orders, you must contact JOAN AYGUADÉ JARQUE so that they can indicate the operation to continue. To prevent the delivery of available products from being delayed, JOAN AYGUADÉ JARQUE recommends not mixing reserve products with the available products in the catalog and placing orders separately.

Delivery and shipment time: JOAN AYGUADÉ JARQUE. used for its shipments Correos and MRW for its shipments in Spain, UPS for Europe and the United Kingdom, as well as DHL for the United States, Canada and the rest from countries of the world. The average delivery time in Spain is between 2 and 3 business days. You also have the option of select express shipping, your order arriving in 24-48 hours. In Europe, the average delivery time is 4 to 6 working days for normal shipping and between 24 and 48 hours for express shipping. For orders outside Europe, the delivery period will be between 3 and 5 days working days. The specified delivery times will be for orders placed on Monday to Friday before 5 p.m. Orders placed on Saturday and Sunday are prepared starting Monday or the first business day.

Current shipping areas are Austria, Belgium, Bulgaria, Canada, Croatia, Cyprus, Czech Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Ireland, Italy, Latvia, Lithuania, Luxembourg, Malta, Netherlands, Poland, Portugal, Romania, Slovakia, Slovenia, Spain, Sweden, Switzerland, United Kingdom and United States.

Pricing policy. JOAN AYGUADÉ JARQUE. unilaterally reserves the right to modify the price of the products offered on this website, the current prices will be applied in the advertising coinciding with the moment of the formalization of the order, to guarantee the veracity of the price of the products to the client.

Online dispute resolution. In accordance with Art. 14.1 of Regulation (EU) 524/2013, the European Commission provides a free access platform for online conflict resolution between the consumer and JOAN AYGUADÉ JARQUE, without need of resorting to the Courts of Justice, through the intervention of a third party, called the resolution body of litigation, which acts as an intermediary between the two. This body is neutral and will dialogue with both parties to achieve an agreement, being able to finally suggest and/or impose a solution to the conflict. Applicable law and jurisdiction. These conditions will be governed or interpreted in accordance with Spanish legislation in what is not expressly established. The parties agree to submit to the courts and tribunals of the domicile of the consumer any controversy that may arise from the provision of the products or services object of these Terms. In the event that the consumer is domiciled outside of Spain, the Parties expressly waive any other forum, submitting to the Courts and Tribunals closest to the population of MADRID.
